{"id":64387,"date":"2023-03-16T05:45:00","date_gmt":"2023-03-16T05:45:00","guid":{"rendered":"https:\/\/groupe-excel.fr\/les-infos-du-jour\/indemnite-deviction-comment-ca-marche\/"},"modified":"2023-03-16T05:45:00","modified_gmt":"2023-03-16T05:45:00","slug":"indemnite-deviction-comment-ca-marche","status":"publish","type":"weblex-importer-post","link":"https:\/\/groupe-excel.fr\/les-infos-du-jour\/indemnite-deviction-comment-ca-marche\/","title":{"rendered":"Indemnit\u00e9 d\u2019\u00e9viction : comment \u00e7a marche ?"},"content":{"rendered":"<div>\n<h2> Indemnit\u00e9 d\u2019\u00e9viction : tout n\u2019est pas \u00e0 inclure !<\/h2>\n<p>Pour m\u00e9moire, \u00e0 la suite de l\u2019annulation de son licenciement, un salari\u00e9 a droit \u00e0 sa r\u00e9int\u00e9gration dans son emploi ou, \u00e0 d\u00e9faut, dans un emploi \u00e9quivalent.<\/p>\n<p>Il a \u00e9galement droit \u00e0 une indemnit\u00e9 d\u2019\u00e9viction dont le but est de r\u00e9parer le pr\u00e9judice subi entre la rupture de son contrat et sa r\u00e9int\u00e9gration.<\/p>\n<p>Mais comment est calcul\u00e9e cette indemnit\u00e9 ?<\/p>\n<ul>\n<li><strong> Exclusion de l\u2019int\u00e9ressement et de la participation<\/strong><\/li>\n<\/ul>\n<p>Dans une 1re affaire, apr\u00e8s l\u2019annulation de son licenciement et sa r\u00e9int\u00e9gration dans l\u2019entreprise, un salari\u00e9 saisit le juge pour calculer le montant de l\u2019indemnit\u00e9 d\u2019\u00e9viction \u00e0 laquelle il a droit.<\/p>\n<p>Selon lui, en effet, l\u2019indemnit\u00e9 d\u2019\u00e9viction doit correspondre \u00e0 l\u2019ensemble des sommes qu\u2019il aurait d\u00fb percevoir, y compris l\u2019int\u00e9ressement, la participation et les cong\u00e9s pay\u00e9s qu\u2019il aurait per\u00e7us s\u2019il avait travaill\u00e9.<\/p>\n<p>\u00ab Pas \u00e0 tout fait ! \u00bb, conclut le juge, pour qui l\u2019indemnit\u00e9 d\u2019\u00e9viction inclut, effectivement, les droits \u00e0 cong\u00e9s pay\u00e9s au titre de la p\u00e9riode d\u2019\u00e9viction (comprise entre la date du licenciement nul et celle de la r\u00e9int\u00e9gration dans son emploi), sauf lorsqu\u2019il a occup\u00e9 un autre emploi durant cette p\u00e9riode.<\/p>\n<p>En revanche, l\u2019int\u00e9ressement et la participation sont exclus du calcul de l\u2019indemnit\u00e9 d\u2019\u00e9viction car ils ne constituent pas des salaires.<\/p>\n<ul>\n<li><strong> D\u00e9duction des sommes per\u00e7ues au titre d\u2019une autre activit\u00e9 et du revenu de remplacement<\/strong><\/li>\n<\/ul>\n<p>Dans une 2de affaire, une salari\u00e9e est licenci\u00e9e par son employeur en raison d\u2019absences inopin\u00e9es et injustifi\u00e9es.<\/p>\n<p>La salari\u00e9e conteste et obtient la nullit\u00e9 de son licenciement et r\u00e9clame, en r\u00e9paration du pr\u00e9judice subi, une indemnit\u00e9 d\u2019\u00e9viction.<\/p>\n<p>Selon elle, l\u2019indemnit\u00e9 doit correspondre \u00e0 une somme forfaitaire \u00e9quivalente au montant des salaires et avantages qu\u2019elle aurait per\u00e7us jusqu\u2019\u00e0 la date effective de sa r\u00e9int\u00e9gration dans l\u2019entreprise, sans d\u00e9duction des \u00e9ventuels salaires ou revenus de remplacement per\u00e7us pendant cette p\u00e9riode.<\/p>\n<p>\u00ab Non ! \u00bb, tranche le juge.
