Syndic immobilier : quel est votre r\u00f4le ?<\/h2>\n

Un copropri\u00e9taire demande au syndicat des copropri\u00e9taires et au syndic de faire enlever le conduit de refoulement de la chaudi\u00e8re de son voisin qui lui cause des nuisances importantes. Face \u00e0 leur refus, il obtient alors de la justice qu\u2019ils agissent. Mais rien ne se passe\u2026<\/p>\n

Face \u00e0 cette absence de r\u00e9action, le copropri\u00e9taire, lui, r\u00e9agit : il r\u00e9clame la d\u00e9signation d\u2019un administrateur \u00ab ad hoc \u00bb pour agir en lieu et place du syndic, l\u2019estimant coupable de carence dans l\u2019exercice de sa mission.<\/p>\n

\u00ab Quelle carence ? \u00bb, s\u2019\u00e9tonne le syndic, qui justifie son inaction par l\u2019existence d\u2019une m\u00e9sentente entre le copropri\u00e9taire et le syndicat des copropri\u00e9taires. D\u2019autant qu\u2019il a toujours parfaitement ex\u00e9cut\u00e9 la totalit\u00e9 du reste de ses obligations\u2026<\/p>\n

Sauf qu\u2019il s\u2019obstine \u00e0 ne pas ex\u00e9cuter une d\u00e9cision de justice, malgr\u00e9 les demandes r\u00e9p\u00e9t\u00e9es du copropri\u00e9taire, constate le juge. Une carence av\u00e9r\u00e9e qui justifie la nomination d\u2019un administrateur ad hoc\u2026<\/p>\n
